Terms of service

01 Acceptance of terms

These Terms of Service ("Terms") are a binding agreement between you and getAIQ LLC ("getAIQ", "we", "us"). By accessing or using getAIQ (the "Service"), you agree to these Terms and to our Privacy & Security policy. If you do not agree, do not use the Service.

02 Eligibility

You must be at least 16 years old to use getAIQ. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

03 Your account

You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. Notify us promptly of any unauthorized use at hey@getaiq.ai. You are responsible for activity under your account.

04 The Service, founding members, and beta

getAIQ provides AI-readiness scoring and guidance powered by QOS v1™. The Service is evolving: founding members are part of the v1 cohort and help shape the methodology. Features, scoring, and tiers may change, and your score may be recalculated as the methodology advances. We may modify, suspend, or discontinue parts of the Service at any time.

05 Acceptable use

You agree not to:

• Use the Service unlawfully or to infringe the rights of others.
• Reverse engineer, scrape, or attempt to extract the QOS methodology or source data except as permitted by law.
• Probe, scan, or breach security, or disrupt the integrity or performance of the Service.
• Misrepresent your identity, submit false information, or impersonate others.
• Resell or commercially exploit the Service or scores without our written permission.

06 Your content

You retain ownership of the information and responses you submit ("Your Content"). You grant getAIQ a limited license to host, process, and use Your Content to operate and improve the Service, consistent with our Privacy & Security policy. We may use de-identified, aggregated data to develop benchmarks and improve scoring.

07 Intellectual property

getAIQ™ and QOS™ are trademarks of getAIQ LLC. The getAIQ wordmark, the Q mark and its double underline, the Q Badge tier seals, the QOS methodology, and all related software, design, and content are owned by getAIQ LLC and protected by intellectual-property laws. Except for the rights expressly granted to you to use the Service, no license is granted.

08 About your AIQ score

Your AIQ is an informational measure of AI readiness produced by QOS v1™. It is not financial, legal, security, investment, or other professional advice, and it does not guarantee any outcome. You are responsible for decisions you make. Because QOS improves over time, scores may change. See How scoring works for detail.

09 Third-party resources

The Service may reference or link to third-party tools, channels, or creators. We do not control and are not responsible for third-party content or services, and references are not endorsements.

10 Disclaimers

THE SERVICE AND ALL SCORES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that scores are complete or accurate for any particular purpose.

11 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, getAIQ LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE PRIOR TWELVE MONTHS OR USD $100.

12 Indemnification

You agree to indemnify and hold harmless getAIQ LLC from claims arising out of your misuse of the Service or violation of these Terms or applicable law.

13 Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will survive.

14 Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in North Carolina, unless applicable law requires otherwise.

15 Changes to these terms

We may update these Terms as the Service and the law evolve. We will revise the "last updated" date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
